Proposed Controlled Parking Zone 'J' - Brook Street, Shugars Green, Brookfield Close and Mill Gardens, Tring

Proposals

It is proposed to implement changes to the existing waiting restrictions on Brook Street, Shugars Green, Brookfield Close and Mill Gardens, Tring. The proposed changes consist of the following:

  • Introduction of No Waiting at Any Time (Double Yellow Line) Restrictions on Brook Street, Shugars Green, Brookfield Close, Mill Gardens.
  • Introduction of a Permit Parking Area Monday to Saturday inclusive, 8am to 6pm.
  • Introduction of Parking Places for Permit Holders Vehicles Only, Monday to Saturday, 8am to 6pm.
  • Introduction of Parking Places for Shared Use (Permit/Limited Waiting) Monday to Saturday, 8am to 6pm.

Reasons

The proposals have been formulated in response to concerns being raised with regards to non-resident vehicles (consisting of shoppers and commuters – whom would not be eligible for a permit) parking on the roads in question, meaning residents are unable to park near their properties.

These measures are also being proposed for the following reasons:

  • To prevent double parking and parking within close proximity to junctions, bends and turning heads where vehicle parking may block access or vehicle manoeuvrability.
  • To enable residents to park close to their homes by preventing commuters/shoppers parking on the road (whom would not be eligible for a permit).
  • To generally improve safety and navigability for road users

Road Traffic Regulation Act 1984

The specific grounds with which the Council are using for the implementation of the proposed scheme as above are encompassed in the following sections of the Road Traffic Regulation Act 1984 for making a Traffic Regulation Order:

  • Section 1 (a) For avoiding danger to persons or other traffic using the road or any other road or for preventing the likelihood of any such danger arising.
  • Section 1 (c) For facilitating the passage on the road or any other road of any class of traffic (including pedestrians).
  • Section 1 (f) for preserving or improving the amenities of the area through which the road runs.
  • Section 32 (b) for the purpose of relieving or preventing congestion of traffic.

Thorough consideration was also given to the factors set out in Section 122 of the Road Traffic Regulation Act 1984 in proposing this Traffic Regulation Order which include:

  • Section 122(2)(a) Securing and maintaining reasonable access to premises

Traffic Signs Regulations and General Directions 2016 and Traffic Signs Manual Chapter 3

All of the associated signing and lining will be in accordance with the Traffic Signs Regulations and General Directions 2016 and Traffic Signs Manual Chapter 3.

Equality Act 2010

Thorough consideration has been given to the equalities duty of the Council under Section 149 of the Equality Act 2010.

Residents and Statutory Consultations

Residents and businesses affected by the proposals were initially consulted over a four-week period from 21st September 2023 to 20th October 2023. A letter, plan as well as information on parking permits was posted directly which explained the proposals and the reasoning behind them.

The extensive consultation process included 244 potentially affected properties and businesses in the area surrounding the proposals on Brook Street and surrounding roads, Tring. From the 65 responses that were received, 30 objections were raised, suggesting that 54% of those that responded to the consultation consider the scheme to be acceptable and are in favour of it.

However, when responses were analysed by street, it was clear that the majority of residents of Brook Street, Brookfield Close and Mill Gardens support the proposed restrictions.

Residents from Plaiters Close or Shugars Green did not support the inclusion of these roads in any form of permit parking zone. It is likely that there will be some form of displacement of vehicles to these roads, from vehicles that will not be eligible for permits within the proposed permit parking area should they not be included in the proposals moving forward. However, the council respects the views of the residents and considered removing these roads from the proposals.

In light of the above, it was recommended that the proposal is modified to remove Shugars Green and Plaiters Close from the proposed permit parking zone in accordance with the majority of residents views from these roads. It was also agreed with members to reconsult with all residents on the newly updated proposals.

The secondary residents consultation was held over a three-week period from 7th February to 1st March 2024. A letter and revised plans were posted directly which notified the residents of the council’s intention to remove Plaiters Close and Shugars Green from the Controlled Parking Zone proposal. Consultees were provided with the opportunity to comment on the revised plans and were able to respond via email or post. The consultation area was the same as the previous residents’ consultation.

Following the completion of the consultation process, a total of 15 responses were received. Of these, 9 were in support, 2 were neither in support nor stated an objection and 4 were objections.

Three of the objectors were residents of Mill Gardens. All three residents were upholding their objections from the previous consultation. The inclusion of Mill Gardens in the Controlled Parking Zone was previously supported by the majority of residents of this road during the previous consultation period.

The final objection received did not relate to Plaiters Close or Shugars Green. The resident objected based on the fact that they would require more permits than are allowed to be purchased.

The only response received relating to the removal of Shugars Green and Plaiters Close from the proposal offered no objections.

In light of the responses received, it is clear that the residents of Plaiters Close and Shugars Green do not object to the removal of their roads from the Controlled Parking Zone proposals.

It was made clear to residents that Shugars Green and Plaiters Close may experience an increase in vehicle parking due to displacement caused by the Controlled Parking Zone should it be implemented in the surrounding roads. It was also made clear to residents that Shugars Green and Plaiters Close would not be able to be included in the Controlled Parking Zone at a later date. The ownership/maintainability status of Plaiters Close and Shugars Green was also explained in the letter since several residents from both roads questioned this during the previous consultation.

The responses received have since been reviewed, and it has been concluded that the residents have no objections to Plaiters Close and Shugars Green being excluded from the Controlled Parking Zone. It is therefore recommended that the revised scheme should be progressed to the statutory public TRO consultation process in order to progress the proposals to the delivery phase of the TRO process (The Notice of Proposal).

Consultation on the Brook Street area proposals has also previously been carried out with Statutory Consultees, including The Police, Emergency Services, Freight Transport Association, Road Haulage Association, and the local stakeholders in September-October 2023. No objections were raised.

A Public Consultation (Notice of Proposal) process is now due to take place, hence the publication of these documents.
